You Do Not Have To Live Here

New York legalized adult-use cannabis under the Marijuana Regulation and Taxation Act (MRTA) in 2021, and the state's Office of Cannabis Management (OCM) licenses every legal dispensary. The law does not care where you live. If you are 21 or older with a valid ID, you can walk into any licensed shop in the state and buy, same as a local.

How Much You Can Buy And Carry

New York sets clear limits for everyone, visitor or local. You can possess up to three ounces of cannabis flower or 24 grams of concentrate at a time. There is a state cannabis tax built into the price (a 13 percent retail tax), so the shelf number is not quite the final number, the same way it works for anything else you buy in New York.

Where You Can And Cannot Use It

Buying is the easy part. Using it has a few common-sense rules that apply to visitors and locals alike.

• Public use is generally allowed wherever smoking tobacco is allowed, but not in cars, parks with their own rules, or on federal land like the Niagara reservation areas. When in doubt, keep it private.
• Never while driving. Driving impaired is illegal and dangerous, and an open product in the car is a problem. If you are out, that is what delivery is for.
