Is THCA Legal in New York?

This is where the smoke-shop marketing falls apart. The pitch goes like this: the 2018 federal Farm Bill defines legal hemp as cannabis with no more than 0.3 percent delta-9 THC by dry weight. Raw THCA flower can technically test under that 0.3 percent delta-9 line, so sellers call it "legal hemp" and stock it on open shelves. The problem is that the moment you smoke it, the THCA decarboxylates into delta-9 THC, and you are smoking what is, for all practical purposes, marijuana.

New York's Office of Cannabis Management saw through this immediately.
